VP, Asst General Counsel for Regulatory and Policy

Our Legal group is looking for an experienced Vice President, Assistant General Counsel for Regulatory and Policy.


Job Summary (Primary function)
The Vice President, Assistant General Counsel for Regulatory and Policy provides legal services and counsel to the U.S. Business. The Vice President assists the General Counsel by providing legal advice on regulatory matters as well as strategic legal support and guidance to the U.S. Business Leadership Team.


Essential Functions of the Job  (Key responsibilities)


    • Provide strategic legal support and guidance to the U.S. Business Leadership Team which advances the company’s business with consideration to legal risks.


    • Collaborate with and advise functional teams supporting the Business on regulatory issues with legal oversight, guidance and counsel in support of the U.S Business activities regarding:


      • Sales


      • Product Strategy


      • New Product Planning


      • Access, Reimbursement and Distribution


      • U.S. Medical Affairs


    • Identify and communicate to clients the risks associated with day-to-day operational business activities, including training clients on applicable legal issues in FDA regulatory matters and compliance with laws, regulations, industry standards and company policies that arise throughout the product lifecycle, including in the areas of product development, regulatory submissions, advertising and promotion.


    • Partner with clients to proactively apply legal and regulatory framework to business activity by understanding business goals and developing solutions when needed to assist in the achievement of objectives including working with clients to develop appropriate and compliant strategies for interacting with healthcare providers, payers, and other stakeholders.


    • Oversee the legal support for the Medical, Legal and Regulatory Review Committee on promotional materials based on the regulations governing pharmaceutical advertising and promotion in support of activities initiated by the above functions.


    • Provide comprehensive legal support in order to identify, manage and help mitigate legal risks including those that involve fraud and abuse and anti--kickback laws.


    • Build constructive working relationships with client base and operates as an active member of both legal and client teams.


    • Provide thoughtful leadership and oversight of the Regulatory Legal department.


    • Engage in initiatives with trade associations and policy teams related to regulatory issues.


Qualifications (Minimal acceptable level of education, work experience, and competency):


    • J.D. from accredited legal degree program as well as active membership in good standing of at least one state bar.


    • 15+ years of related experience, with at least 5 years in-house legal experience in a pharmaceutical company.


    • Solid working knowledge of commercial programs in a pharmaceutical company (both pre and post launch of a product) as well as the statutes, regulations and guidance documents applicable to these activities (e.g., the Food, Drug and Cosmetic Act, regulations and guidance documents; the federal and state anti-kickback statutes, regulations and OIG guidance documents and opinions; the federal False Claims Act; the Prescription Drug Marketing Act and regulations; HIPAA; and ACCME policies and guidelines).


    • Good general working knowledge of liability issues and significant experience with contract negotiation.


    • Strong written and verbal communications skills, including the ability to communicate concisely to clients, to integrate legal and business knowledge and to provide balanced advice regarding risks.


    • Ability to manage multiple tasks simultaneously and to flourish in a fast-paced environment.
